These Terms and Conditions ("Terms") govern your use of makinacafenyc.com (the "Site"), operated by Makina Cafe ("Makina," "we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable law or regulation
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems
• Introduce viruses, malware, or other harmful code
• Use automated systems (bots, scrapers, crawlers) to access the Site in a manner that sends more requests than a human could reasonably produce
• Copy, reproduce, or redistribute Site content except as permitted in Section 4
• Submit false, misleading, or fraudulent information through our forms
• Interfere with any other party's use of the Site

We reserve the right to restrict or terminate access to the Site at our discretion.

3.1 Inquiries are not bookings. Submitting an inquiry through our catering form is a request for information only. It does not create a contract, reserve a date, or guarantee availability. No booking exists until we confirm it with you in writing and any required deposit is received.

3.2 Quotes. Any pricing, package, or budget range shown on the Site is an estimate for general guidance. Final pricing depends on your menu, guest count, location, date, staffing, and other factors, and will be confirmed in a written quote. Quotes are valid for the period stated in the quote.

3.3 Separate agreement governs events. Confirmed catering and event bookings are governed by a separate catering agreement or event contract between you and Makina, which will address deposits, cancellation, rescheduling, final headcount deadlines, service, and payment terms. In the event of any conflict between these Terms and a signed catering agreement, the catering agreement controls.

3.4 Food truck bookings. Food truck bookings are subject to seasonal availability, minimum spend requirements, and location-specific permit, power, and access requirements. We will confirm feasibility for your location before any booking is finalized.

All content on the Site — including text, photographs, graphics, logos, the Makina name and marks, page design, and layout — is owned by Makina or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and print pages for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, or create derivative works from Site content without our prior written permission.

Menus, hours of operation, pricing, and location information on the Site are provided for general reference and are subject to change without notice. We make reasonable efforts to keep this information current but do not guarantee its accuracy at any given time.

Dish availability varies. Seasonal locations, including our Governors Island location and the food truck, operate on limited schedules.

Descriptions of dishes on the Site are provided for general information and may not list every ingredient.

Our kitchen handles common allergens, including but not limited to wheat, gluten, dairy, eggs, soy, sesame, tree nuts, peanuts, fish, and shellfish. We cannot guarantee that any dish is free from any specific allergen, and cross-contact is possible.

If you or a guest has a food allergy, intolerance, or dietary restriction, you must inform us directly before ordering or booking so we can discuss whether we can safely accommodate you. Do not rely solely on Site content.

Restaurant reservations are handled through Resy, a third-party platform. Reservations made through Resy are subject to Resy's own terms of service and to any reservation, cancellation, or no-show policies we set. We are not responsible for the availability or performance of the Resy platform.

The Site contains links to third-party websites and services, including Resy, Google Maps, and social media platforms. These links are provided for convenience. We do not control and are not responsible for the content, accuracy, policies, or practices of third-party sites. Accessing them is at your own risk.

Job listings and career information on the Site are informational and do not constitute an offer of employment. Submitting an application does not create an employment relationship or any contractual obligation. All employment with Makina is at-will unless otherwise stated in a signed written agreement.

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, or current.

TO THE FULLEST EXTENT PERMITTED BY LAW, MAKINA CAFE, AMICHE HOSPITALITY, AND THEIR OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for personal injury caused by our negligence or for fraud.

You agree to indemnify and hold harmless Makina Cafe, Amiche Hospitality, and their owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Queens County, New York, and you consent to the personal jurisdiction of those courts.

We may revise these Terms at any time. When we do, we will update the "Last Updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Makina regarding your use of the Site, and supersede any prior agreements on that subject.
